Please read these Terms and Conditions carefully before using the services.
1. Introductory provisions
1.1 These General Terms and Conditions ("GTC") set out the terms and conditions and detailed rules for the use of the "Rollet" Application operated by Sparking Invest, a private limited company, and the Service available through the Application.
1.2 These GTC constitute the general terms and conditions of the contract pursuant to § 6:77 of Act V of 2013 on the Civil Code.
1.3 These GTCs form an integral part of the Framework Contract, the Individual Contract and the Surety Contract. Accordingly, the Framework Agreement, the Individual Contract and the Surety Contract shall only be validly concluded after the express acceptance of the GTC and the prospectus relating to the Surety Contract. By using the Service, the User expressly acknowledges that he/she has read, understood and accepted the provisions of these GTC (including the Annexes).
1.4 By accepting the GTC, the User acknowledges that he/she may not exercise his/her right of withdrawal/cancellation under Government Decree 45/2014 (26.II.) on the detailed rules of contracts between consumers and businesses after the entire service has been completed (i.e. after the successful exit from the Parking Garage) with respect to the completed Individual Contract (and the related Framework Contract), and by creating the first Individual Contract, the User expressly agrees to the commencement of the provision of the Service to him/her.
1.5 The Service Provider provides a complex parking service for Users through the "Rollet" Application, which includes a simple payment solution that improves the User's parking experience.
2. Information about the Service Provider:
3. Concepts
Capitalised terms used in these GTC shall have the following meanings:
3.1 Privacy Policy: the Privacy Policy, which is part of these GTC and is attached as Annex 1 to these GTC, containing the detailed rules of data management in the course of the Service.
3.2. Application: application (IT application) developed by the Service Provider and the exclusive property of the Service Provider, on which the User can complete his/her Registration for the Service via his/her Mobile Device and which he/she can use to use the Service after the Registration.
3.3.GTC: The present General Terms and Conditions of the Service Provider, which regulate the legal relations between the Service Provider and the User/Business User and between the User and the Parking Garage.
3.4. Bank card: the bank card provided and registered by the User during the Registration, which is used to pay the Parking Fee for the parking used.
3.5. Leased User: All Users who have a parking permit issued by the Parking Garage for a particular Parking Garage are considered as Leased Users. The Parking Houses shall provide the Service Provider with the data of the Rented User as specified in the contract concluded with the Service Provider.
3.6. Individual Contract: means the agreement for each Parking, which may be concluded between the User and the Service Provider after the conclusion of the Framework Contract by the User's implicit conduct, when the User enters the Parking area with the Vehicle through the entrance provided by the Parking Garage for parking purposes.
3.7 Facebook Connect: registration mode available to Users who are registered on www.facebook.com. From the Registration screen, it is possible to proceed to the 'Connect with Facebook' screen, where you can register by entering the email address and password used on the social networking site, and your mobile phone number. The User expressly acknowledges that if his/her Facebook account is deleted from the Community Site or becomes unavailable to him/her for any reason (for example, is suspended by Facebook), he/she will no longer be able to access his/her User Account within the Service through the Application. However, the User Account shall not be deemed to be deleted and shall in any case be subject to a separate request to the Service Provider in accordance with the provisions of these GTC.
3.8. Suspension: means the case where the Service Provider suspends the possibility to use the Service for a specific User or Vehicle due to the fact that the Service Provider does not have the Total Bail Amount available for a specific User.
3.9.User: a natural or legal person over the age of 18 who downloads the Application and registers through the Application in order to use the Service and enters into a contract with the Service Provider, who is not limited in his/her capacity, who accepts and acknowledges the provisions of these GTC and the Privacy Policy as binding upon him/her.
3.10. User Account: a password-protected individual interface created by the Service Provider for the User within the Application during the Registration process, where the User can access and modify his/her personal data and access information related to the Service.
3.11. Payment Service Provider: myPOS Payments Ltd. which enables the User to pay the Parking Fee and the Total Security Amount easily and quickly through the application and online payment system operated by it.
3.12. Google Connect: registration mode available to those who are registered on www.google.com. From the Registration screen, you can proceed to the 'Connect with Google' screen, where you can register by entering the email address and password used on the social networking site, and your mobile phone number. You expressly acknowledge that if your Google Account is deleted from the Community Site or becomes unavailable to you for any reason (for example, if it is suspended by Google), you will no longer be able to access your User Account within the Service through the App. However, the User Account will not be considered as deleted and must be requested separately from the Service Provider in each case in accordance with the provisions of these TOS.
3.13. Vehicle: a vehicle which is fixed and not immobilised by the User through the Application, driven by a power engine and which has 4 or more wheels.
3.14. Rewards: the User may, through the continuous use of the Service, obtain Parking Entitlements of various values from the Service Provider or, where applicable, from some of the Service Provider's partners.
3.15. Camera system: a stand-alone, uninterrupted camera system is operated at the gates of the Parking Garage(s) to identify the Vehicles using the Service and to measure the Parking Time. One camera scans the license plate numbers of all vehicles entering and exiting the Car Park and another camera is activated when a Vehicle is detected by the camera scanning the license plates.
3.16. Framework Agreement: a framework agreement for the use of the Service, concluded between the User and the Service Provider, with the content as per Annex 2, for an indefinite period of time, during which the User is entitled to use the Service and to create a Unique Contract.
3.17. Mobile Device: a technical device with IOS or Android operating system capable of mobile data traffic and mobile communication, in particular, but not limited to, a smartphone, tablet, phablet.
3.18. Receipt.
3.19. Security Deposit: the amount of security deposited by the User as security for the Parking Fee claim by payment to the Service Provider's bank account and available at all times with the Service Provider in respect of the User. The detailed rules relating to the Security Deposit, in particular the rules on the use of the Security Deposit, are set out in Clauses 9 and 10.
3.20. Bailment Contract: means the contract for the Total Bail Amount payable by the User to the Service Provider, concluded between the Service Provider and the User in accordance with these GTC.
3.21. Parking: the process whereby a User uses the Service in a particular Parking Garage on the basis of the relevant Individual Contract.
3.22. Parking Fee: the amount of money to be paid by the User to the Service Provider as consideration for the use of the Service, which is determined on the basis of the Parking Garage's tariffs, based on the unit of account (e.g. hour or minute) defined by the Parking Garage.
3.23. Start of Parking Time: The time when the entry of the Vehicle is successfully detected and recorded by the Camera System installed in the Parking Garage.
3.24. Parking Time: The period of time starting at the Parking Time Start and ending at the time when the Vehicle's exit is successfully detected and recorded by the Camera System installed in the Parking Garage.
3.25. Parking garage(s): depending on the context, means, on the one hand, a third party legal entity having a contractual relationship with the Service Provider for the provision of the Service, which actually makes the parking space used in the course of the Service available to the User, and, on the other hand, a parking garage or parking hall garage located in Hungary, on the territory of which the parking spaces used in the course of the Service are located.
3.26. Registration.
3.27. Barrier: A structure operated by the Parking Garage, the main function of which is to allow the entry and exit of Vehicles into and out of the Parking Garage. It depends on the type of Car Park whether it is equipped with a Barrier.
3.28. Service: the "convenience" service provided by the Service Provider to Users, which includes the payment facilitation service and the fact that the Service Provider leases, on a non-exclusive basis, the right to use and exploit an unspecified number of parking spaces in the Car Parks and temporarily transfers the right to use a specific parking space from this number of parking spaces to the User on the basis of a Contract between the Service Provider and the User at the time of conclusion of the Individual Contract. The Service Provider shall allow the User to use this parking space against payment of a fee and the User shall pay the Parking Fee directly to the Service Provider.
3.29. Service Provider: Sparking Invest, a private limited company, is the sole and exclusive owner, creator and operator of the Rollet system on which the Service is based.
3.30. Interruption: cases when the Service cannot be used by Users due to a fault or other technical problem.
3.31. Total Security Deposit Amount: the amount of the Security Deposit required to use the Service, which is HUF 1,900, i.e. one thousand nine hundred forints. The Service Provider is entitled to modify the amount of the Total Bail Amount in accordance with the rules governing the modification of these GTC.
3.32. Website: the website operated by the Service Provider in connection with the Service, located at the URL www.rollet.app. www.rollet.app URL címen található.
4. Scope, content and amendment of the GTC
4.1 These GTC apply to the Service Provider and to the User who enters into a contract with the Service Provider for the use of the Service. For the avoidance of doubt, these GTC do not contain the details of the agreement between the Service Provider and the Car Park, nor the applicable Car Park regulations, however, the User shall accept and comply with the applicable Car Park regulations when using the Service.
4.2 The User is entitled to use the Service if he/she successfully completes the registration process in accordance with clause 5.2.
4.3 These GTC shall be in force from 10 October 2020 until revoked or until the relevant amendment enters into force.
4.4 Should any provision of these GTC, the Framework Agreement or the Security Agreement be or subsequently become invalid or unenforceable, this shall not affect the validity of the other provisions of the document concerned.
4.5. Amendments to the GTC
4.5.1 The Service Provider reserves the right to amend these GTC, in whole or in part, from time to time. In the event of any modification to these GTC, the Service Provider shall make the fact of the modification, a concise summary of the changes, indicating the provisions modified, the effective date of the modification and the full text of the modified GTC available to the User at least ten (10) days prior to the effective date and shall send it to the User's e-mail address associated with the User Account and publish it on its Website.
4.5.2 Amendments to the GTC shall not affect Individual Contracts already in force at the time of their entry into force, but shall extend to Framework Contracts in force at the time of their entry into force, which shall be governed by the GTC from the date of entry into force of the amendment, in accordance with the amended terms.
4.5.3 Framework Contracts concluded after the entry into force of the amendment to the GTC shall be governed by the GTC as amended.
4.5.4 Following the entry into force of the amended GTC, the User's continued use of the Service shall constitute acceptance of the amended GTC in full.
4.5.5 The Service Provider may deviate from the provisions of clause 4.5 of the GTC only in the event that and to the extent that the amendment of the GTC is required by a law, the adoption of which is less than the period of time specified in the above-mentioned clause of the GTC.
5. Terms and Conditions of Use of the Service, Registration and Contract Procedure
5.1 After registration, the User, by concluding a Framework Agreement, acquires the right to use the Service, subject to availability, by concluding a Single Contract until the expiry of the Framework Agreement, except in the case of Suspension and Termination. Use of the Service (and the conclusion of Individual Contracts) is only possible on the basis of a valid and effective Framework Contract and Bail-in Contract and only if the full Bail-in Amount is available for the User with the Service Provider.
5.2. The Registration
5.2.1. First stage of registration
5.2.1.1.1 Registration requires you to download and run the Application. The User downloads the Application from the App Store or Play Store to a Mobile Device capable of running the Application.
5.2.1.1.2 To log in to the Application for the first time, you must provide one of the following to begin the Registration:
5.2.1.3.The User can log in to the Application after providing the above.
5.2.1.4.After the above, in order to proceed within the Application, it is in any case necessary that the User accepts the GTC and the Privacy Policy by ticking the checkbox and receives promotional inquiries. In addition, when logging in with Facebook Connect or Google Connect, the User must also consent to the Service Provider accessing the personal data stored in his/her Facebook and Google profile in order to access the Application.
5.2.1.1.5. Upon completion of the Registration steps described in this Section 5.2.1, the User Account will be created, but the Registration is not complete and the Service is not yet available.
5.2.2. Second stage of RegistrationFollowing the first stage of Registration, the User must complete the second stage of Registration in order to make full use of the Service. The second stage of Registration consists of the steps set out in the following paragraphs:
5.2.2.1.The User fills in the registration form within the Application and provides his/her family name, name, e-mail address and telephone number. If the User is a legal entity, the registration process requires the provision of company details and the details of a contact individual.
5.2.2.2.2 After the User has approved the registration form, the User will receive a verification SMS message to the telephone number provided. The SMS message contains a confirmation code, which the User confirms by entering via the Application.
5.2.2.2.3 After confirming the telephone number, the User will receive a verification e-mail to the e-mail address provided, in which he/she will click on a link to confirm his/her e-mail address.
5.2.2.2.4. After confirming the email address, the User shall record the registration number of the vehicle or vehicles with which he/she wishes to use the Service via the Application. An unlimited number of license plates can be assigned to a User Account.
5.2.2.2.5. After confirming the email address, the User accepts the information about the Bail Bond Agreement by checking the box, enters into the Bail Bond Agreement and selects the method of payment of the Total Bail Amount. The rules governing the Bail are set out in clause 9 of these GTC.
5.2.2.2.6. Next, the User must provide the details of the Bank Card with which he/she will be able to make subsequent payments, as follows:
5.2.2.2.7. The Service Provider shall confirm the User's registration declaration by e-mail without delay. If a confirmation is not received within 24 hours at the e-mail address provided by the User, the User shall notify the Service Provider thereof. Confirmation of the Registration by the Service Provider is the last step of the Registration process, the confirmation completes the Registration.
5.2.3. Other provisions related to the Registration
5.2.3.1 Finalisation of an incomplete Registration: in the event of failure to complete any of the steps in Sections 5.2.1 and 5.2.2, you may complete the steps within the Application after logging in. When exiting the registration form, a pop-up question will appear asking whether the User wishes to save the data already entered. If the User saves the partially completed registration form, the next time the Application is opened, only the additional missing data and registration steps need to be entered and completed.
5.2.3.2. Correction of data entry errors: before completing the Registration, the User can identify and correct data entry errors under the "PROFILE" menu. The User is entitled to modify and correct his/her data recorded in the User Account at any time after the completion of the Registration.
5.2.3.3.The User undertakes and is solely responsible for making only truthful and not misleading statements during and after the registration for the Service, and shall ensure that the data provided during the registration are always true and up-to-date during the period of use of the Service, and to update them without delay if necessary, and the Service Provider shall not be liable for any damages resulting from failure to do so. The User, being aware of his/her criminal liability, expressly declares that the personal, billing or other data provided by him/her to the Service Provider in any way during the use of the Service are true and correct and do not infringe the rights or legitimate interests of the Service Provider or third parties. If the Service Provider becomes aware or is likely to become aware that the data provided by the User are not or partially not true, accurate, complete or otherwise contain unlawful or non-contractual elements, the Service Provider shall be entitled to refuse the Service and to apply additional legal sanctions as provided for in these GTC and in the applicable legislation.
5.2.3.4 The verification and determination of the existence of the conditions set out in clause 5.2.3.3 shall be at the discretion of the Service Provider. The Service Provider shall be entitled (but not obliged) to verify the accuracy and veracity of the data provided in the User Account and the circumstances necessary for the use of the Service at any time, and to request the User to present the documents supporting the veracity of the data provided to the Service Provider's customer service by sending a request by e-mail within a reasonable period of time (which shall be at least 20 calendar days). If the User fails to comply with the request within the given time limit, i.e. fails to verify the existence and validity of the requested data or if the Service Provider, in its sole discretion, does not find them to be legitimate, it shall be entitled to terminate the Framework Contract concluded with the User with immediate effect or to terminate the User's User Account without any further claim for justification, compensation, indemnification or any other compensation. In case of false data or misuse of data, the Service Provider will take the necessary legal action against the User.
5.3 Authentication of the Vehicle
5.3.1 The User may authenticate the Vehicle via the Application (by granting the Application access to the camera of the Mobile Device) by taking a photograph of the Vehicle with the Vehicle visible from the front, the license plate clearly visible and the driver's side door clearly open, thus demonstrating the right of control over the Vehicle.
5.3.2 If a Vehicle has been registered without authentication in accordance with clause 5.3.1 above, the following information will be available through the Application in respect of that Vehicle:

5.4. Conclusion of the Framework Agreement
5.4.1. The User concludes the Framework Agreement with the Service Provider upon completion of the Registration. The Framework Agreement is concluded when the User successfully registers within the Application and the Service Provider confirms the User's successful registration by e-mail (effective date). Thereafter, a Framework Agreement for the use of the Service concluded electronically for an indefinite period of time is concluded between the Service Provider and the User.
5.4.2 A User may only have one Framework Contract at a time.
5.4.3.The Service Provider informs the User that the Framework Agreement to be concluded is a written contract and that the Framework Agreement will be recorded by the Service Provider in the system for registering contracts for the Service. The Service Provider shall make the Framework Agreement available to the User upon the User's written request by e-mail or by post. The language of the Framework Agreement shall be Hungarian.
5.4.4.4 The Service Provider reserves the right to refuse to conclude a Framework Contract if a person wishes to conclude a Framework Contract in respect of which it is suspected that he/she would not comply with the obligations arising from the GTC or the Bail Bond Contract, including in particular if fraud, false or incomplete data provision is suspected.
5.5. Conclusion of the Individual Contract
5.5.1 By accepting these GTC, the User expressly accepts and acknowledges that by entering the Parking Garage (as a direct action), a contract for the use of the Service, concluded electronically in accordance with the provisions of these GTC, is concluded between the User and the Service Provider, through the GTC, for the duration of the Parking, i.e. for a limited period of time.
5.5.2. The date of conclusion and commencement of the Individual Contract is the Parking Period Commencement Date.
5.5.3 In the event that the identity of the registered User and the driver of the Vehicle are different, by using the Service, the User and the person who actually drives the Vehicle expressly acknowledge by implicit conduct that the person who actually drives the Vehicle is entitled to use the Service in the place of and on behalf of the User and that he/she has express authorisation from the User to do so, but any act related to the Service during the term of the Individual Contract shall be deemed to be an act of the User.
6. Cancellation of User Account and termination of the Framework Agreement
6.1. Termination of the Framework Agreement by the User and deletion of the User Account
6.1.1.1 The User shall be entitled to terminate the Framework Contract at any time by unilateral, unjustified declaration to the Service Provider, including the right of withdrawal and termination pursuant to Article 20 of Government Decree 45/2014 (26.II.26.) on the detailed rules of contracts between consumers and businesses.
6.1.2 The User can delete his/her User Account and make a declaration to terminate the Framework Agreement at any time by using the "DELETE ACCOUNT" button located under the "PROFILE" menu item under "My Account".
6.1.3 After pressing the "DELETE ACCOUNT" button, the User will be asked to confirm his/her intention to delete the User Account on two confirmation screens.
6.1.4 On the first confirmation screen, the User will receive a general warning about the consequences of deleting the User Account. The Service Provider will warn the User that as a consequence of the deletion of the User Account, all available Rewards, vehicles (both active and suspended) recorded in the User Account will be lost and the User will no longer have access to the "SAVE" function. The User will be warned that the cancellation of the User Account, once confirmed, is final and irrevocable.
6.1.5. On the second confirmation screen, the User will receive an itemized list of the consequences of deleting the User Account, which are: (i) the cancellation of the User Account is final and irrevocable; (ii) the User must re-register to continue using the Service; (iii) the Rewards will be permanently lost; (iv) the User will no longer have access to the "LOG" function; (v) the User will no longer have access to the customer support chat history and error tickets; (vi) the Deposit will be refunded to the bank account number associated with the Bank Card within 15 (fifteen) days. In the second confirmation screen, the User confirms and sends to the Service Provider his/her declaration to cancel the User Account and terminate the Framework Agreement by entering his/her password for the User Account or by entering the word "CANCEL" and then by clicking on the "CANCEL USER ACCOUNT" button.
6.1.6 On the next screen, the Service Provider confirms the deletion of the User Account and the receipt of the User's declaration of termination of the Framework Agreement.
6.2. Termination of the Framework Agreement by the Service Provider
6.2.1.The Service Provider shall be entitled to terminate the Contract at any time, including in cases of serious breach of contract by the User, by unilateral declaration to the User. The Service Provider shall inform the User of the termination of the Framework Agreement by e-mail. The Service Provider may terminate the Contract without prior notice.
6.2.2.A serious breach of contract by the User shall be deemed to include, but not be limited to, making false statements about the User's eligibility, providing false information in whole or in part, using the Service to the detriment of the Service Provider or a third party, and failing to meet any payment obligation of the User within the time limit.
6.3 Other rules governing termination of the Framework Agreement
6.3.1 The date of termination of the Framework Agreement in the event of termination by the User is the date of confirmation of termination by the User in accordance with clause 6.1.5 and sending of the termination notice to the Service Provider, which will be confirmed by the Service Provider. The Service Provider's termination shall take effect upon the sending of an e-mail message to the Service Provider by the User.
6.3.2 Upon termination of the Framework Agreement by either party, the Security Deposit Agreement shall automatically terminate and the Service Provider shall refund the available Security Deposit to the User within 15 (fifteen) days to the bank account associated with the Bank Card belonging to the User Account.
6.3.3.If the Bank Card (and the related bank account) has been terminated or has ceased to exist for any reason and it is not possible to repay the Deposit to the User, the Service Provider shall notify the User by e-mail and shall remind the User to arrange for the provision of a new Bank Card in order to repay the Deposit. The Service Provider shall not be liable for any delay in repayment of the Security Deposit, nor for any default interest or any other claim, or, if the User fails to comply with this clause and does not request repayment from the Service Provider within 60 (sixty) days, for the repayment of the Security Deposit.
6.3.4 If the User initiates the termination of the Framework Agreement during the use of the Service, during a Parking Session, the User shall settle the Parking Fee directly with the Parking Garage.
7. Use of the Service
7.1 The Service is available on the terms and conditions set out in these GTC.
7.2 The list of the Parking Houses, the number of free spaces in the given Parking House (which is an indicative data and the Service Provider does not assume any responsibility for its accuracy) and the tariff applicable to the given Parking House are available to the User within the Application.
7.3 The range of vehicles that may be used to access the Service may be limited by the governing rules of the Car Parks, including, but not limited to, the categories of vehicles and the types of fuel that may be used.
7.4 A vehicle registered in a User Account cannot belong to another User Account. A vehicle can only belong to one User Account.
7.5 Only one Bank Card may be associated with a User Account.
7.6 By entering the Parking Garage, the User and the driver of the Vehicle agree to the applicable regulations of the Parking Garage, including the applicable rates. The User and the Driver of the Vehicle shall inform themselves about and comply with the applicable regulations of the Car Park.
7.7. Use of the Service
7.7.1 The Service Provider shall monitor vehicles entering and exiting the Parking Garage via the Camera System installed at the entrance and exit of the Parking Garage.
7.7.2 The Service is automatically started when the Camera System detects a Vehicle. When a Vehicle enters the Parking Garage, the Camera System automatically identifies the Vehicle's license plate number and records the time and date of the entry into the Parking Garage on an image recording. The Service Provider records the time elapsed since the Parking Time Start.
7.7.3 When a Vehicle is driven out of the Parking Garage, the Camera System automatically identifies the Vehicle's registration number, records the exit on a picture and the Parking Fee is paid in accordance with the provisions of Clause 10 of these GTC.
7.8. Important reminders:
7.8.1 The Service Provider draws the attention of the Users to the fact that the images of the Camera System may also record passengers in the Vehicle entering and exiting the Parking Garage. The User shall be solely responsible for informing persons using or staying in the Vehicle of this fact and for the fact that images of third parties other than the User may appear on the images of the Vehicle when using the Service.
7.8.2. The Service Provider also expressly draws the attention of the Users to the fact that it has information about which Parking Garage a given Vehicle is in when using the Service and that it makes this information available to the User via the Application for the Vehicle authenticated in accordance with 5.3.3. Given the fact that a User may add more than one Vehicle to his User Account, the User shall be obliged to provide information on the previous ones. In addition, the User shall inform in advance all users of the Vehicle of the scope of the data processed by the Service Provider, including the availability of the data relating to the location (the specific Parking Garage).
7.8.3 The Vehicle may only stay in the Parking Garage for the maximum period of time specified in the relevant regulations of the Parking Garage, i.e. the Parking Time may not exceed this maximum period. The Service Provider shall not be liable for any legal consequences arising from non-compliance with the foregoing.
7.8.4. The User is entitled to use the Service if the Full Bail Amount is available with the Service Provider. The payment of the Full Bail Amount is governed by Clause 9 of these GTC.
7.8.5 If the Full Bail Amount is not paid during the Registration, the User must validate the Bank Card provided during the Registration by paying HUF 100. The payment of this amount shall constitute a single verification payment only, and upon successful debiting of the HUF 100, the amount shall be credited to the User immediately.
7.9. Collection and use of the Reward
7.9.1 The User may collect Rewards during the continuous use of the Service, which may be used exclusively for the payment of the Parking Fee. The conditions for collecting the Reward shall be determined by the Service Provider periodically and individually. The Service Provider shall issue separate information on the promotions related to the Rewards.
7.9.2.The User may decide in the "BENEFITS" menu of the Application whether to use the balance of the Reward available to him/her to pay the Parking Fee. In this case, the Parking Fee will either be paid in full from the Reward or the amount of the Parking Fee will be reduced by the amount of the Reward.
7.9.3.The User can continuously check the balance of the available Rewards via the Application under the "BENEFITS" menu item.
8. The Application
8.1 The Application developed by the Service Provider can be downloaded to Mobile Devices running Android and iOS operating systems from the App Store or Play Store.
8.2 The User can complete the registration within the Application.
8.3 When accessing the Application, the User will be presented with the "HOME PAGE" where the following functions are available:
8.3.1.1. "LOGIN" : The User can log in to the Application by entering his/her e-mail address and password. If necessary, the User can request a password reminder function by pressing the "ENTER PASSWORD" button to the e-mail address provided in his/her User Account.
8.3.1.2. "NEW REGISTRANT ACCOUNT" : The function to initiate the Registration process in accordance with clause 5.2 of these GTC.
8.3.1.3 "LOG IN ONLY" : In case of registration, it is possible to log in for the first time with Facebook Connect or Google Connect via this menu item. To log in to User Accounts via Facebook Connect or Google Connect.
8.4. The following menu items are available within the Application after logging into the User Account:
8.4.1.1. "DASHBOARD";
8.4.1.2. "PROFILE";
8.4.1.3 "MAP";
8.5. "FUNCTIONS" menu item
8.5.1 The first interface after login, which is also the central interface of the Application.
8.5.2 The User will be notified of any important system messages (e.g. that the e-mail address provided is awaiting confirmation or that the recorded vehicle has not yet been authenticated) via this interface.
8.5.3 Under the menu item "TOOLS", a reduced size version of the map function of the Service is available, on which the User can access information about the Parking Houses located nearby and the number of available parking spaces in the Parking Houses, as well as the fees charged by the Parking Houses. The information on the number of free spaces available in the Car Parks within the Application is for information purposes only and the Service Provider shall not be liable for any discrepancy between the actual data and the data on the number of free parking spaces displayed in the Application.
8.5.4 The "Pending Parking" is displayed in the "PURCHASE" menu, by clicking on the pending Parking the User can access the details of the given Parking.
8.5.5.The Service Provider is entitled to place news, advertisements and promotions on the "MUSICPHONE" menu at any time.
8.6. "PROFILE" menu item
8.6.1. "FIÓKOM" submenu item
8.6.1.1 The top sub-menu item of the "PROFILE" menu item, which is located above the other sub-menu items and is also marked by a green circle.
8.6.1.2.Personal data can be modified under the sub-menu "LOGIN", namely: (i) "full name", "e-mail", "phone number" and "change password". Under the sub-menu item "ACCOUNT", the User can log out or initiate the deletion of User Accounts in accordance with clause 6.1 of these GTC by pressing the "DELETE USER ACCOUNT" button.
8.6.1.1.3 In case of entering a new e-mail address, the User shall authenticate the newly entered e-mail address by means of the authentication link sent to the newly entered e-mail address.
8.6.1.4 In the case of entering a new telephone number, the User shall confirm the newly entered telephone number by entering the code received in the SMS message sent to the telephone within the Application.
8.6.2. sub-menu item "SUMMARY"
8.6.2.1 Under this sub-menu item, the User can access the history of his/her previous Parking history for the vehicle(s) recorded.
8.6.2.2 Under the sub-menu item "TICKETS", the User's individual virtual parking tickets are available, which, depending on whether the User has authenticated the Vehicle or not, contain the information according to clauses 5.3.2 or 5.3.3 of these GTC.
8.6.3. submenu item "VEHICLES":
8.6.3.1 In the sub-menu "VEHICLES", the User can remove a previously entered vehicle by deleting the registration number or enter a new registration number to register a new vehicle. The User can assign a unique name to each vehicle.
8.6.3.2 Under the sub-menu item "VEHICLES", the User can select each vehicle and view the "LOG" for that vehicle, which contains the relevant Parking History.
8.6.3.3.3 The User has the right to suspend a particular Vehicle at any time through the Application by selecting the "SUSPEND" option under the sub-menu item "VEHICLES".
8.6.3.4 If a Vehicle is suspended, the Service will not be available for that Vehicle until the Vehicle is reactivated. To reactivate the Vehicle, deactivate the "SUSPEND" button under the submenu item "VEHICLES".
8.6.3.5 Parking Charges incurred during the commencement and progress of Parking shall be payable irrespective of the suspension of the Vehicle during the period of Parking.
8.6.4. sub-menu item "PAYMENT METHOD"
8.6.4.1 The balance of the Reward can be accessed and viewed under this submenu item.
8.6.4.2.The User may delete or add a new Bank Card to his/her User Account in the sub-menu "OPERATION MODE". It is not possible to change the Bank Card details. Only one Bank Card can be assigned to a User Account.
8.6.4.3 In the event of a new Bank Card being issued, the User shall make a HUF 100 check payment through the Payment Service Provider, which amount shall be credited to the User without delay. Only one Bank Card can be associated with a User Account, so it is only possible to enter new Bank Card details if the previously registered Bank Card is cancelled by the User. If a previously registered Bank Card is deleted and no Bank Card is registered in the User Account, the User is not entitled to use the Service until he/she has registered a Bank Card, and the Service Provider will notify the User of this via the Application.
8.6.4.4.4 Under the sub-menu item "BONDING MODE" you will find the sub-menu item "BONDING", where the User can check the available Bonds associated with his User Account at any time. A separate button under the sub-menu item "BOND" is used to upload the amount of the Bond up to the Total Bond Amount.
8.6.5. sub-menu item "SUPPLY DATA"
8.6.5.1 If the User wishes to request an electronic invoice instead of the Open invoice, he/she can activate the request invoice function by pressing the appropriate button. When activating the invoice request function, the User must provide the data related to the issuing of the invoice.
8.6.5.2. The User may deactivate the invoice request function at any time if he/she no longer wishes to request an invoice.
8.6.6. submenu item "RECOVERIES"
8.6.6.1. Submenu item for the provision of information by the Service Provider to the User. In the cases specified in these GTC, the Service Provider shall also send push notifications to the User. The User shall be entitled to deactivate push notifications at any time.
8.6.7. sub-menu item "CONVERSION"
8.6.7.1. The User can contact the Service Provider's customer service through this sub-menu item via live chat.
8.6.7.2 The sub-menu item "CONVERSION" can be accessed from several screens via the icon in the top right corner of the Application. It is also possible to communicate with the Service Provider's customer service while using other functions of the Application.
8.7. "SPACE" menu item
8.7.1.1.1 By clicking on the miniature version of the map function in the "MAP" menu or by clicking on the menu item "MAP", the User can access the submenu item "MAP".
8.7.1.2. The sub-menu item "SPACE" lists the Parking Houses that can be used using the Service (the number of available spaces in the respective Parking Houses is indicated in the Application). For each Parking House, the User can estimate the fee by setting the planned Parking duration through the Application.
8.7.1.3 By clicking on each Car Park, the User can access information related to that Car Park, which includes (i) the name of the Car Park; (ii) its address; (iii) its price estimate for 1-2-3-10 hours; (iv) its opening hours; and (v) other related information (e.g. web address).
8.7.1.4 The map screen may also be used to launch navigation applications provided by other service providers, which are Google Maps, Apple Maps and Waze, depending on the type of Mobile Device used by the User.
9. The Bail Bond Contract
9.1. Rules for the collection and management of bail
9.1.1.1 The User shall enter into a Bailment Agreement with the Service Provider in the manner and with the content set out in these GTC. The Bailment Agreement shall secure the Service Provider's claim for the Parking Fee. The User expressly agrees that no interest shall accrue on the Security Deposit and that the Service Provider shall not be liable to pay any interest on the Security Deposit.
9.1.2. By accepting these GTC, the User acknowledges that the use of the Service is subject to the availability of the Full Bail Amount with the Service Provider.
9.1.3 In the legal relationship created by the Bailment Agreement, the Service Provider is the bailee and the User is the bailee.
9.1.4 The User shall transfer the Security Deposit to the Service Provider up to the Total Security Deposit Amount via the payment interface provided by the Payment Service Provider by means of a payment by Bank Card or by authorizing the Service Provider to block or debit the Bank Card as detailed in clauses 9.1.5-9.1.9 below.
9.1.5. First payment of the Full Bail Amount: the User may choose to pay the Full Bail Amount to the Service Provider at the time of registration or, if the User chooses the option under clause 7.8.5, at the time of the first use of the Service. In the first case immediately, whereas in the case of 7.8.5, the Service Provider will charge the Bank Card for the Total Security Amount at the time of the first Parking upon the first Parking. In both cases, the User authorises the Service Provider to debit his/her Bank Card up to the Total Bail Amount at the same time as entering into the Bail Bond Agreement. If the debiting of the User's Bank Card fails, the User shall not be entitled to use the Service.
9.1.6. Replenishment of the Security Deposit if the Security Deposit has been used in whole or in part:If the Security Deposit is used in whole or in part by the Service Provider pursuant to clause 9.2 of these GTC or if the Security Deposit has been reclaimed by the User or the Total Security Deposit is not available for any other reason, the Security Deposit will be replenished as follows:
9.1.7. By accepting these GTC, the User agrees and acknowledges that the Service Provider is entitled to modify the current amount of the Total Security Amount at any time. The detailed rules governing the modification of the Total Security Amount are set out in the relevant amendment to the GTC.
9.1.7.1. Reduction of the Total Security Amount: if the Service Provider reduces the Total Security Amount, the Service Provider will credit the difference between the Security Amount and the Expected Security Amount that will be applied as a result of the reduction to the User's Bank Card. If the amount of the Security Deposit is lower than the amount of the Expected Security Deposit to be applied as a result of the reduction, the provisions of Clause 9.1.6 shall apply.
9.1.7.2. Increase of the Total Security Amount: if the Service Provider increases the Total Security Amount, the User shall not be entitled to use the Service until the applicable Expected Security Amount resulting from the increase is available with the Service Provider for the User. The provisions of Clause 9.1.6 shall apply to the addition to the amount of the Expected Bail Amount to be applied as a result of the increase.
9.1.8 By accepting these GTC, the User acknowledges that the Service Provider has the right to suspend the Service in respect of the User if the Full Bail Amount is not available with the Service Provider. The Service Provider shall immediately notify the User of the Suspension of the Service by sending a push notification.
9.1.9.The amount of the Security Deposit may be different from the Total Security Deposit amount under the rules for the use of the Security Deposit under these GTC, but may not exceed the Total Security Deposit amount. The User can always check the available Bail amount via the Application under Profile / Payment Method / Deposit. The Bail shall have the same meaning as the Deposit in the Application.
9.1.10. After the confirmation of the User's Registration by the Service Provider in accordance with clause 5.2.2.7, the User shall be entitled to use the Service when the Payment Service Provider confirms the crediting of the Total Security Amount to the Service Provider.
9.1.11. The Service Provider shall inform the User that the Bailment Contract to be concluded shall be a written contract and the Bailment Contract shall be kept by the Service Provider in its contract registration system.
9.1.12. The Parties expressly acknowledge that the Bailment Agreement shall be treated as a separate contract from the Framework Agreement and that if the Bailment Agreement should be invalid for any reason, the invalidity of the Bailment Agreement shall not affect the validity of the Framework Agreement and these GTC.
9.1.13. The Service Provider shall keep the Security Deposit belonging to each User separately from its own assets and shall keep a record of it in such a way that, upon request of the User, it can be proved and identified at any time that the User has transferred the possession of the entire Security Deposit to the Service Provider and the current amount of the Security Deposit can be verified. The Service Provider shall not use or exploit the Bail Assets belonging to the User, except in the cases provided for in Clauses 9.2 and 10 of these GTC, but shall be entitled to use any interest on the Bail Assets to cover its own reasonable costs (e.g. costs related to the management of the bail account).
9.1.14. The User, as a bailor, shall be entitled to reclaim the Security Deposit and to initiate settlement of the Security Deposit even during the term of the Security Deposit Agreement. The recovery of the Bail may only be made through the Application at the same time as the cancellation of the Bank Card associated with the User Account. In the event of a reclaim of the Deposit, the Payment Service Provider will transfer the Deposit back to the Bank Card.
9.1.15. In the event of cancellation of a Bank Card, the User will only be able to use the Service if he/she provides a new Bank Card linked to his/her User Account via the Application.
9.1.16. Reclaiming a Bail Bond does not terminate the Bail Bond Agreement.
9.1.17. The Surety Agreement shall terminate simultaneously with the termination of the Framework Agreement.
9.2. Use and repayment of the Security Deposit
9.2.1 The Service Provider's right of satisfaction shall arise when the claim secured by the Security becomes due, i.e. in the event of non-payment of the Parking Fee by the User. Upon the opening of the right of satisfaction, the Service Provider shall acquire ownership of the part of the Security Deposit corresponding to the unpaid Parking Fee by means of a unilateral declaration addressed to the User.
9.2.2.2 The Service Provider shall immediately notify the User by sending a push notification within the Application and by sending a message to the telephone number associated with the User Account that the debit of the Parking Fee to the Bank Card was unsuccessful and that the amount required to settle the Parking Fee will be deducted from the Security Deposit.
9.2.3 In the event of termination of the Framework Agreement by either party, the Security Deposit shall be refunded by the Service Provider to the User within 15 days to the bank account associated with the Bank Card. The User expressly agrees that no interest shall be payable on the Security Deposit. The User may notify the Service Provider of the termination of the Framework Agreement in accordance with the provisions of clause 6.1.1 of these GTC.
9.2.4. The User is responsible for ensuring that the bank details provided on the Payment Service Provider's interface are correct.
10. Payment
10.1 During the Registration, the User registers his/her Bank Card with the Payment Service Provider and grants the payment authorisations under these GTC, thus authorising the Service Provider to block an amount on his/her Bank Card equal to the Parking Fee and the Total Security Amount calculated on the basis of the current Parking Time and the Parking Time, and to debit the Bank Card with this amount. The User is obliged to accept the Payment Service Provider's general terms and conditions and the payment transaction rules.
10.2 The Parking Fee is calculated on the basis of the Parking Time and the hourly or per-minute rate set by the Parking Garage. The Service Provider shall not, and the Parking Garage shall be entitled to unilaterally change the hourly or per-minute rate on which the Parking Fee is based, in accordance with its own applicable regulations.
10.3 The Service Provider shall not be liable in any way whatsoever for the hourly or per minute rate on which the Parking Fee is calculated and, in particular, shall not be liable for any changes to the relevant data and for keeping it up to date. The tariffs provided by the Car Parks to the Service Provider will be updated in the Application on the basis of the data provided by the Car Park.
10.4 The Parking Fee shall always be paid in HUF and the Parking Fees are always gross prices, which include the current value added tax (VAT).
10.5. Payment procedureThe User shall pay the Parking Fee calculated on the basis of the Parking Time as follows:
10.6 The Service Provider will send a confirmation of the Parking Fee to the e-mail address associated with the User Account. The receipt will be issued automatically by the Service Provider.
10.7 Within the Application, the User can request a VAT invoice under the menu item "Billing Address". In this case, the User must provide the requested billing details.
10.8 Upon payment of the Parking Fee, the Individual Contract shall terminate.
10.9 Users who are Renting Users for a particular Parking Garage are not obliged to pay a Parking Fee for the use of the Service in such Parking Garages.
10.10. Certain cases of payment of the Parking Fee based on the Parking Time
10.10.1 The Parking Fee shall not exceed the Total Security Deposit.
10.10.2. Parking Fee is more than the Total Bail Amount, and the Bank Card is successfully blocked
10.10.3. Parking Fee More Than Total Bail Amount and Bank Card Blocking Failed
10.10.4.Rules on grace periods
11. Data protection
11.1 In connection with the Service, personal data of the User and of any individual using the vehicle with the User's permission and providing the User with the information in this Policy will also be processed. The detailed rules of data processing are set out in a separate Privacy Policy, which forms part of the GTC. The User acknowledges that by accepting the GTC through registration, he expressly accepts the Privacy Policy.
11.2 The Privacy Policy is available at https://rollet.app/en/privacy/ .
12. Responsibility
12.1 The information on the number of free parking spaces available in the Car Parks within the Application is based only on the information obtained from the Car Parks, and the Service Provider does not assume any responsibility for the fact that the number of free parking spaces in the given Car Park is the same as the information indicated in the Application.
12.2 The Service Provider shall not be liable for any damage caused to the User's Vehicle during parking in the Parking Garage.
12.3 The User, irrespective of the legal title of his/her use of the Vehicle, warrants that he/she will use the Vehicle lawfully and that he/she will only lawfully transfer the use of the Vehicle to others in connection with the use of the Service. The Service Provider shall not be liable for the right of the person who actually uses the Vehicle to use the Vehicle and to use the Service.
12.4 The Service Provider shall not be liable for any damages arising from the use of the Vehicle.
12.5. The Service Provider shall not be liable for the use of the Service by the User's unlawfully used Vehicle.
12.6.The User acknowledges that the Service Provider has no control over the operation of the Payment Service Provider, and therefore the Service Provider shall not be liable for the proper operation of the Payment Service Provider, including but not limited to any technical, administrative or other errors made during the payment process, including, but not limited to, the Payment Service Provider's possible incorrect deduction of a Parking Fee from the User's credit card. In such a case, the User shall, in addition to directly contacting the Payment Service Provider, also report such errors to the Service Provider.
12.7 The Service Provider does not assume any liability for any malfunction or unforeseen failure of the Parking Garage.
12.8 The Parking Houses are obliged to provide the Service Provider with the data of the User. The Service Provider shall not be liable in any way whatsoever for the correct transfer of the Data of the User by the Parking Facilities to the Service Provider.
12.9 The Service Provider will update and improve the Application on a regular basis. The Service Provider shall not be liable or obliged to pay any compensation for any damage in connection with the uninterrupted, virus-free and unhindered availability or other interruption of the Application or the Service. If the Application or Service is interrupted, the Service Provider will take all reasonable steps to notify Users of the expected interruption.
12.10. The Service Provider shall not be liable for any failure of the User's Internet connection or the operating system of the User's device that prevents access to the Application.
12.11. The Service Provider shall not be liable if the User is prevented from exiting the Parking Garage (e.g. due to a malfunction of the Barrier).
12.12. The Service Provider shall not be liable for any costs and damages resulting from the User initiating parallel parking (either manually or via any other dedicated Application) when entering the Parking Garage.
12.13. The Service Provider shall not be liable in any way if the User provides false information during or after registration.
12.14. The Service Provider shall not be liable for the User's data becoming available to unauthorized persons through the Application, if it is made available to unauthorized persons through the fault of the User. The User shall take all measures necessary to protect his/her data in the event that the device on which he/she has installed the Application is accessed by unauthorised persons.
12.15. The Service Provider shall not be liable for the User's damage caused by circumstances beyond the Service Provider's control and unforeseeable at the time of the conclusion of the contract.
12.16. The Service Provider shall not be liable for the User's ability to find a free parking space in the parking garage visited by the User, which is suitable for the technical parameters of the Vehicle.
13. Intellectual property rights of the Service Provider
13.1 The Service Provider is the exclusive owner of the "Rollet" designation. The User shall not be entitled to use, register or otherwise claim or enforce any rights in the "Rollet" mark or any other mark that may be confused with it as a trademark, trade name, business name, domain name or otherwise, without the express prior written consent and permission of the Service Provider.
13.2 The User shall not use the term "Rollet" in a manner that is contrary to these GTC or the legitimate or commercial interests of the Service Provider.
13.3. By downloading the Application, the User acquires a non-exclusive, non-transferable, non-exclusive right to use the Application for the duration of the contract, covering the territory of Hungary. The User may not sell or transfer the right of use to third parties. The User may not copy, reverse engineer, disassemble or attempt to reverse engineer the source code of the Application, or copy the Application or any part or update thereof, or attempt to develop an application derived from it.
13.4. By downloading the Application and using the Service, the User does not acquire any rights of the Service Provider with respect to the intellectual property rights of the Application and the Service, in particular copyrights and industrial property rights, beyond the user rights set forth in Section 13.3.
13.5.The Service Provider warrants that it is the owner of all intellectual property rights, in particular copyright and industrial property rights, in the Application and the Service and that no third party has any right to them that would prevent, restrict or exclude the User from using the Application or the Service.
13.6.The Service Provider reserves the right to all copyright content and industrial property rights in the Service system, as well as in the broader elements of the Service, including, but not limited to, domain rights.
13.7 The Service Provider reserves the right to enforce its rights and claims against the infringer in court in order to protect its legitimate interests in the event of infringement of its intellectual property rights.
14. Complaints handling, consumer protection
14.1 The Consumer can contact the Service Provider with complaints and comments by sending an e-mail to the Service Provider's e-mail address ugyfelszolgalat@rollet.app or by using the Application.
14.2 The Service Provider can only act in the case of complaints and comments directly related to the Service. In other cases, the User may contact the party providing the Service concerned by the complaint or comment (e.g. Parking Garage, Payment Service Provider).
14.3 In order to settle a consumer dispute out of court, the User may apply to the conciliation body of his/her place of residence or domicile. The conciliation body shall attempt to reach an agreement between the Parties in order to settle the consumer dispute and, if this is unsuccessful, shall decide on the matter in order to ensure the simple, quick, efficient and cost-effective enforcement of consumer rights.

15. Other provisions
15.1 These GTC shall be governed by Hungarian law.
15.2.For issues not regulated in these GTC, the relevant provisions of Act V of 2013 on the Civil Code, Government Decree 45/2014 (26.II.) on the detailed rules of contracts between consumers and businesses, Act XLVII of 2008 on the prohibition of unfair commercial practices against consumers, Act CVIII of 2001 on certain aspects of electronic commerce services and information society services shall apply mutatis mutandis.The Parties shall settle any disputes amicably and through negotiations. The User shall address any complaints, concerns or any other issue related to the Service or the Application to the Service Provider in the first instance in order to resolve and settle the dispute efficiently, promptly and amicably. If this is not possible, the Parties submit to the exclusive jurisdiction of the Hungarian courts to settle their dispute.

You can do so by checking the box for data processing when you install the Application. The full Notice is available on the hyperlinks provided next to the checkbox before you select the checkbox during installation. If the User does not consent to the processing of the data, the Service cannot be used.
The Service Provider uses short texts, anonymous user identifiers, so-called cookies, on its Website to enhance the user experience and to make the use more convenient. Cookies store unique computer identifiers and profile information on the computer or device of the Website Visitor. Cookies cannot be used to identify the Website Visitor personally, but they can be used to identify and recognise the Website Visitor's computer or device.The Website Visitor can set his/her browser to prevent cookies from being placed on his/her computer or device. The Service Provider may use the advertising services of third-party service providers, whereby the third-party advertising service provider may save the Website Visitor's data, in particular the fact of the visit, the time of the visit, the time spent on the Website, etc., using cookies, in order to enable the Website Visitor to receive targeted advertising for the Service. The Website Visitor will be informed of this separately and will be required to give his/her separate consent to receive such advertising.
The Service can only be accessed by downloading, installing and using the Application. During the installation of the Application, the Service Provider obtains from the online store that enables the download of the Application the download data (such as the time of download of the Application and the name of the online store that enables the download of the Application), as well as the following personal data of the User: the type of software of the mobile device used by the User and information on whether the User is over 18 years of age. By installing the Application, the User consents to the processing of these data by the Service Provider.If the User consents to this during the installation or use of the Application, the Application will access the following applications of the mobile device on the User's mobile device: camera, photos, location data. Authorisation to access the camera and photos is not essential to use the Service, but without access to location data, the Service cannot be used.

If the User chooses to access the Application with his/her existing Facebook or Google account instead of entering a separate username and password, by entering and confirming this, the User agrees that the Service Provider may receive certain data from Facebook or Google in accordance with Facebook and Google's policies, or that the Service Provider may access the User's following personal data:
In addition to the above, the Service Provider does not receive any other data from Facebook or Google.3. The personal data necessary for the registration for the Service and for the payment of the fees and costs of the Service by the User (see below) are not processed by the Service Provider, but by the operator of the myPOS service used by the User, iCard AD, myPOS Payments Ltd. The personal data processed by the Payment Service Provider as a data processor for the purposes of payment transaction processing, payment transaction authentication and prevention of possible fraud are the following: the number of the credit card provided by the User, the expiry date, the name of its holder, the CVC code, the name of its owner (the bank issuing the credit card), the User's name, telephone number, e-mail address, the amount of the transaction, the IP address of the device sending the transaction, the date and time of the transaction, the billing address. The sub-activities performed by the Payment Service Provider as a data processor include the recording, storage, transmission to authorization partners, deletion of all these personal data. The Payment Service Provider may use the following sub-processors to authenticate payment transactions and prevent fraud:
The Payment Service Provider shall be responsible for the sub-processors it uses as if it were performing the sub-processing activities itself. The Payment Service Provider shall only be entitled to use a sub-processor that complies with the applicable data protection legislation and the provisions applicable to the data processor under the Payment Service Provider's General Terms and Conditions, in particular, but not limited to, data security requirements.The Service Provider shall not automatically receive from the Payment Service Provider all such personal data provided by the User to the Payment Service Provider, but shall only receive a series of accounts generated by the Payment Service Provider on the basis of all such personal data. The above personal data provided by the User to the Payment Service Provider cannot be decrypted from the number series generated on the basis of the credit card data and cannot be accessed by the Service Provider, however, upon the Service Provider's request, the Payment Service Provider may provide the Service Provider with credit card data.4. As set out in the General Terms and Conditions for the use of the Service ("GTC"), it is the User's responsibility to ensure that no persons are included in the photographs or short video clips of the Vehicle and it is the User's responsibility to ensure that he/she legally owns the copyright of these images and can legally provide copies of them to the Service Provider for the purpose of providing the Service.Given the fact that a User may register more than one Vehicle within the Application, by accepting this Policy, the User declares that he/she understands that he/she is under an obligation to inform all users of the Vehicle registered in the Application of the scope of the data processed by the Service Provider, as provided for in the GTC.
1. Scope of personal data. The Service Provider processes personal data that is essential for the safe use of the Service through the Application, in addition to the personal data required for registration for the Service (see 3.1), the User's personal data related to parking, which are the following: the place and time of arrival and departure of the Vehicle to and from the parking space (Parking Garage), the parking fee and location, the photograph or video image of the Vehicle (and its driver, passengers) at the time of arrival and departure.2The camera surveillance system installed by the Service Provider in the parking garage. The Service Provider shall operate a separate, uninterrupted camera system at the access gates of the parking garage(s). One camera shall scan the license plates of all vehicles entering the Car Park and another camera shall be activated when the camera scanning the license plates evaluates a license plate registered by a User to use the Service. Their operation is governed by the provisions of Act CXXXIII of 2005 on the Rules of Personal and Property Protection and Private Investigation (hereinafter referred to as the "Act on the Protection of Personal and Property Protection and Private Investigation"). The purpose of the recordings is asset protection: to reduce the risk that the Service may not be unlawfully used by a person entering the parking space (parking garage) at the User's expense with a vehicle having the same license plate number as the Vehicle but with a different vehicle from the Vehicle, and thus to protect the User's property, since the detection of infringements, the detection of the perpetrator in the act or the prevention of such infringing acts, their proof cannot be achieved by other methods, and the use of these technical means is indispensable and does not entail a disproportionate restriction of the right to informational self-determination. The Service Provider shall store the recordings in a closed IT system separate from the Parking Garage. The Service Provider shall inform third parties in an appropriate manner of the fact and the angle of view of the camera surveillance. The Service Provider shall delete the recordings without delay, but within the time limit set by the applicable legislation (see III.3 below).3. Parking garages providing parking spaces for use by the Service Provider (hereinafter referred to as "Parking Garage(s)") may operate camera surveillance systems. The Service Provider is not responsible for the operation of these cameras, the User can obtain information about them from the Parking Garage. The User who has authenticated his/her Vehicle within the Application by means of a photograph or a video recording shall benefit from the following advantages:
In comparison, the User who does not authenticate his/her Vehicle can only know the date and the current duration of the parking, the current parking fee, the Vehicle's registration number and the total amount of the parking at the end of the parking, but not the approximate location (parking area) and the exact duration of the parking in the Application during and after the parking.For the avoidance of doubt, the Service Provider will process the personal data listed above even if the User does not authenticate his/her Vehicle, the difference resulting from the authentication is that the unauthenticated User will only be able to know certain information if and to the extent that he/she requests information from the Service Provider regarding the processing of his/her personal data and only in relation to his/her personal data.
The User can make a complaint about the Service as described in the GTC. In connection with the handling of complaints, the Service Provider shall process the personal data provided by the User in the course of the complaint (in particular, but not limited to, the time and manner of the complaint, the detailed description of the complaint, the circumstances of the use complained about, the documents submitted in connection with the complaint), as well as the personal data processed in the course of the provision of the Service to the User to the extent necessary for the handling of the complaint. The Service Provider shall inform Users separately about the procedure for handling complaints.
In order to promote the Service among Users, to promote the awareness and use of the Service and to increase the quality of the Service, the Service Provider shall process the surname, first name (gender), e-mail address, home or postal address, telephone number and mobile phone number of Users.Data processing for marketing purposes may be processed by the Service Provider only with the express consent of the User, and the Service Provider shall immediately cease processing data for this purpose upon the express request of the User. When subscribing to the newsletter, the date of subscription and the IP address at the time of subscription may also be recorded.By subscribing to receive the newsletter and direct marketing materials, the Data Subject consents to the Service Provider sending the Data Subject an electronic message containing advertising, information about current information, promotions, new features, games, etc.
The Service Provider monitors and manages the number of cars entering the Car Parks for business development purposes, and generates statistics and statements from other anonymised data in order to improve the Service.
In order to provide the Service in a complete and smooth manner, the Service Provider shall, as necessary, closely cooperate with the Parking Houses, and shall transmit to them the Vehicle registration number, the time of arrival and departure of the Vehicle at the Parking House (i.e. the parking time), the images and video recordings of the Vehicle (entry and exit), the approximate location of the parking (parking area), the parking fee and the pricing of the parking passes per parking space. In the event that the remaining parking fee exceeds the bail amount requested by the Service Provider when registering for the Application, the Service Provider shall transmit to the Parking Garage, for the purpose of payment of the parking fee, in addition to the above, the surname, first name and telephone number of the User. The Parking Houses act as independent controllers of all these personal data, as parking is carried out on the basis of a contract with the Parking House.
The Service Provider prepares and issues the invoice for the Service using a software operated by KBOSS.hu Kft. (headquarters: 1031 Budapest, Záhony utca 7.). This company may know the content of the invoices (the User's surname, first name (gender), address or postal address, billing address (if different from the address), as well as the duration of the User's parking and the parking fee) to the extent and for the minimum time necessary to perform all these tasks in order to operate, maintain and troubleshoot the invoice-issuing software. In this context, KBOSS.hu Kft. acts as a data processor on behalf of the Service Provider.
In cases provided for by law or by a final court decision, the Service Provider may disclose all personal data processed to law enforcement authorities (in particular, but not limited to, the police, defence and national security services).
The Service Provider may transfer the personal data described in this Notice to advisors (including, but not limited to, accountants, financial and legal advisors) engaged by the Service Provider in order to comply with its legal obligations or to secure its claims and enforce its rights and legitimate interests.

The Service Provider shall retain the personal data related to the handling of complaints for five (5) years from the date of the complaint (or, if the limitation period for the assertion of claims is longer, until the end of this period) in order to enforce its own and the User's (consumer's) rights and legitimate interests.5.
The Service Provider keeps the personal data at its headquarters (1146 Budapest, Szabó József utca 6.).
The legal basis for the processing (collection, storage, transmission, etc.) of the personal data listed in this Notice by the Service Provider is the voluntary consent of the Data Subjects (Website Visitor, User, etc.), in accordance with Section 5 (1) a) of Act CXII of 2011 on the Right to Informational Self-Determination and Freedom of Information (hereinafter: "Infotv") and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016.) on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Regulation (EC) No 95/46 (General Data Protection Regulation; hereinafter referred to as "GDPR") pursuant to Article 6 (1) a). The Service Provider shall process personal data related to the handling of complaints in accordance with Act V of 2013 on the Civil Code and Article 17/A of Act CLV of 1997 on Consumer Protection.
1.It is of paramount importance to the Service Provider that the personal data it handles or processes are secure and that no data security incident occurs that could lead to the accidental or unlawful destruction, loss, alteration, unauthorized disclosure of or access to personal data transmitted, stored or otherwise processed (a data breach).2. The Service Provider shall raise and develop the data protection awareness of these persons through data protection training in order to prevent data breaches from occurring and to facilitate the efficient, prompt and reassuring handling of any data breach that may occur.3The Service Provider shall implement appropriate technical and organisational measures to ensure a level of data security appropriate to the level of risk, taking into account the state of the art and the cost of implementation, the nature, scope, context and purposes of the processing, and the varying likelihood and severity of the risk to the rights and freedoms of natural persons, including, where appropriate, ensuring the pseudonymisation and encryption of personal data, the continued confidentiality, integrity, availability and resilience of the systems and services used to process personal data.4In the event of a physical or technical incident, the Service Provider shall restore access to and availability of personal data in a timely manner and shall keep the measures taken under constant review.5. The Service Provider shall ensure a procedure for the regular testing, evaluation and assessment of the effectiveness of the technical and organisational measures taken to guarantee the security of data processing.6.
1. The right to transparent information and communication. The Service Provider shall take appropriate measures to provide the Data Subject with all information and communications concerning the processing of personal data in a concise, transparent, intelligible and easily accessible form, in clear and plain language. The current version of this Notice on the processing of personal data by the Service Provider is available to the Data Subject on the Service Provider's website and within the Application. The Data Subject shall have the right to obtain from the Service Provider feedback as to whether or not his/her personal data are being processed and, if such processing is ongoing, the right to access the scope of the personal data, the purposes of the processing, the recipients of the processing, the envisaged duration of the storage of the data, information on the source of the data or other information specified by law.3. The Data Subject shall have the right to obtain from the Service Provider, upon his/her request and without undue delay, the rectification or integration of inaccurate personal data relating to him/her. The Service Provider expressly requests all Data Subjects to initiate the correction of inaccurate personal data with the Service Provider in the event of any change of data, the detection of incorrect data or the provision of false data.4. The Data Subject shall have the right to obtain from the Service Provider, upon his/her request, the restriction of processing where the Data Subject contests the accuracy of the personal data, the processing is unlawful and the Data Subject requests the restriction of the use of the data instead of the erasure of the data, the Controller no longer needs the personal data for the purposes of processing but the Data Subject requires them for the establishment, exercise or defence of legal claims or the Data Subject has objected to the processing.5. The Data Subject has the right to receive personal data concerning him or her that he or she has provided to the Service Provider in a structured, commonly used, machine-readable format and the right to transmit such data to another controller without hindrance from the Service Provider to whom the personal data have been provided.6. The Data Subject shall have the right to object at any time, on grounds relating to his or her particular situation, to the processing of his or her personal data where the processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller, or where the processing is necessary for the purposes of the legitimate interests pursued by the Service Provider or a third party, including profiling based on the aforementioned provisions. In such a case, the Service Provider may no longer process the personal data unless it can demonstrate compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject or for the establishment, exercise or defence of legal claims.7. The Data Subject may exercise the rights set forth in this Section VII by sending a request to the Service Provider's e-mail address support@rollet.app.8. The Service Provider shall designate a Data Protection Officer, given that the Service, as the core business of the Service Provider, involves processing operations which, by their nature, scope and/or purposes, require a systematic and systematic high level of monitoring of Data Subjects. 1. The User may only provide his/her real data for the registration or use of the Service. The Service Provider shall not be liable for any legal consequences arising from the fact that the User has provided false or not his/her own data.2. The Service Provider shall be entitled to request verification of the data in accordance with the general terms and conditions of the contract concluded between the Service Provider and the User for the use of the Service.3.The Service Provider reserves the right to modify this Notice at its own discretion in the future, in particular in the event of changes in legislation, in order to ensure that the information contained in this Notice provides adequate information about the collection and processing of the Data Subjects' personal data.5.In the event of a modification of the Notice, the Service Provider shall send the fact of the modification, a concise summary of the changes, indicating the modified provisions, the date of entry into force of the modification and the full text of the modified Notice to the Users at the e-mail address provided by them during registration at least ten (10) days before the entry into force, and shall also publish it on the Website.6.

By entering into this Framework Agreement (hereinafter referred to as the "Framework Agreement"), the User acquires the right to use the convenience parking service (hereinafter referred to as the "Service") provided by the Service Provider during the term of this Framework Agreement by entering into Individual Contract(s).
The terms and conditions of the use of the Service are set out in the "Sparking Invest General Terms and Conditions" (hereinafter referred to as the "GTC").
The GTC and its annexes form an integral part of this Framework Agreement.
The User declares that prior to registering as a user, he/she has read, understood and accepted the GTC, including the Privacy Notice attached to the GTC, the information contained in the GTC pursuant to Government Decree No. 45/2014 (26.II.2014) and the special rules for distance contracts, and acknowledges that he/she is bound by the provisions of the GTC.
The Framework Agreement and the GTCs contain all the terms and conditions relating to the services covered by the contract in their entirety, and any statements, offers or commitments made during the conclusion of the contract which are not included in this Framework Agreement do not form part of the contract. Upon the conclusion of this contract, all previous oral or written discussions and agreements on this subject shall be null and void. Any custom or practice agreed between the Parties in their previous business relations or established between them shall not form part of this contract. Nor does it include any custom or practice which is widely known and regularly used by the parties to a similar contract in the same line of business.
